AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend and reenact §§ 30-414, 30-418, and 30-420 of the Code of Virginia, relating to Commission on Federally Recognized Tribes; purpose; powers; sunset extended.

 

Be it enacted by the General Assembly of Virginia:

1. That §§ 30-414, 30-418, and 30-420 of the Code of Virginia are amended and reenacted as follows:

§ 30-414. Commission on Federally Recognized Tribes; purpose.

The Commission on Updating Virginia Law to Reflect Federal Recognition of Virginia Federally Recognized Tribes (the Commission) is established in the legislative branch of state government for the purpose of performing a comprehensive review of reviewing Virginia law to assess recommend ways in which it must can be revised to better reflect the government-to-government relationship between the Commonwealth should maintain, by treaty and applicable federal law, with the sovereign, self-governing, and federally recognized Tribal Nations tribes located within the present-day external boundaries of the Commonwealth.

§ 30-418. Powers and duties of the Commission; report.

The Commission shall have the following powers and duties:

1. Performing a comprehensive review of Reviewing Virginia law to reflect ensure that it appropriately reflects the government-to-government relationship between the Commonwealth and federally recognized Tribal Nations tribes located in the Commonwealth as distinct governments with the right to exercise general sovereignty and powers of government.

2. Submitting to the General Assembly and the Governor an annual report for publication as a report document as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports. The chairman of the Commission shall submit to the General Assembly and the Governor an annual executive summary of the interim activity and work of the Commission no later than the first day of each regular session of the General Assembly. The executive summary shall be submitted for publication as a report document as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports and shall be posted on the General Assembly's website.

§ 30-420. Sunset.

This chapter shall expire on July 1, 2026 2027.
