AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to direct the Virginia Lottery and the Virginia Department of Agriculture and Consumer Services to assess the regulation and taxation of fantasy contests in the Commonwealth; report.

 

Be it enacted by the General Assembly of Virginia:

1. § 1. That the Virginia Lottery and the Virginia Department of Agriculture and Consumer Services (VDACS) are directed to assess the regulation and taxation of fantasy contests in the Commonwealth. Such assessment shall include a review of similarities and differences between fantasy contests and sports betting, whether and to what extent fantasy contests and sports betting should be regulated and taxed in the same manner, how other states treat the regulation and taxation of fantasy contests, including a review of the metrics by which fantasy contests and sports betting are taxed in other states, and whether the Virginia Lottery, VDACS, or another agency of the Commonwealth is the most appropriate agency to administer regulations related to fantasy contests. The Virginia Lottery and VDACS shall report on their assessment and any findings and recommendations to the General Assembly no later than November 1, 2026.
