AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 22.1-23.7, relating to Department of Education; English language learner students; expenditures; data collection; report.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 22.1-23.7 as follows:

§ 22.1-23.7. English language learner students; expenditures; data collection; report.

The Department, in consultation with each school board, shall annually collect, maintain, post publicly and conspicuously on its website, and report no later than November 1 to the Board, the Governor, and the General Assembly data on expenditures for the education of English language learner students in each local school division. The report shall include data on the average expenditure for the education of English language learner students for the applicable year (i) disaggregated for each school in the school division and (ii) for each elementary school in the school division, in the aggregate, as compared to each secondary school in the school division, in the aggregate.
