AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding in Article 2 of Chapter 17 of Title 63.2 a section numbered 63.2-1718.1, relating to Department of Social Services; unlicensed care home; registration.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 2 of Chapter 17 of Title 63.2 a section numbered 63.2-1718.1 as follows:

§ 63.2-1718.1. Unlicensed care homes; registration.

A. As used in this section, "unlicensed care home" means a residential adult care setting that provides room, board, and some level of services for three or fewer unrelated individuals but is not licensed or certified by the Commonwealth.  [ "Unlicensed care home" does not include a continuing care provider or community-based continuing care provider registered with the State Corporation Commission pursuant to Chapter 49 (§ 38.2-4900 et seq.) of Title 38.2. ]

B. Every person that constitutes, or that operates or maintains, an unlicensed care home shall register such home with the Commissioner. The Commissioner, upon request, shall consult with, advise, and assist any person interested in registering any such home. Such registration shall be made to the Commissioner, in such form as he may prescribe. It shall contain the name and address of the registrant and, if the registrant is an association, partnership, limited liability company, or corporation, the names and addresses of its officers and agents. The registration document shall also contain a description of the activities proposed to be engaged in and the facilities and services to be employed, together with other pertinent information as the Commissioner may require.
