Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 22.1-23.7 as follows:

§ 22.1-23.7. English language learner students; expenditures; data collection; report.

The Department, in consultation with each school board, shall annually collect, maintain, post publicly and conspicuously on its website, and report no later than November 1 to the Board, the Governor, and the General Assembly data on expenditures for the education of English language learner students in each local school division. Such data shall be disaggregated by school level, grade level, and student English proficiency level. [ Such annual report shall contain recommendations for any increase in funding pursuant to the general appropriation act or amendment to subsection F of § 22.1-253.13:2, or both, that may be necessary to ensure that the actual cost of educating English language learner students is accurately reflected in the Standards of Quality funding formula. ]
