In any year in which a Phase I or Phase II utility is exempted from making a deficiency payment resulting from a lack of available RECs from geothermal heating and cooling systems, the utility shall, for that compliance year, procure and retire RPS eligible RECs subject to a $45 per megawatt hour deficiency payment in an amount equal to the amount of RECs from geothermal heating and cooling systems that were not made available at a price that was equal to or below $100 per megawatt hour in that compliance year pursuant to subdivision C 1 b.
