AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 32.1-137.05:1, relating to nonemergency medical transportation providers; fee disclosure.
Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 32.1-137.05:1 as follows:
§ 32.1-137.05:1. Nonemergency medical transportation providers; fee disclosure.
A. As used in this section, "nonemergency medical transportation provider" means any person who exclusively transports passengers for compensation to, from, or between medical care facilities or providers, unless such service is provided through the state plan for medical assistance.
B. A nonemergency medical transportation provider shall, prior to providing nonemergency medical transportation services to a patient, provide the patient or the patient's representative with a written disclosure of all associated fees or other charges, including the total out-of-pocket cost, for which the patient will be responsible for such transportation services. Such disclosure shall include a statement indicating that the total out-of-pocket cost for such transportation services included on the disclosure reflects the cost without insurance. The nonemergency medical transportation provider may make such disclosure through a method reasonably expected to provide advance notice to patients, including a brochure, invoice, or website.
