Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 8 of Title 63.2 a section numbered 63.2-807 as follows:

§ 63.2-807. Burial assistance program.

A. A local department may pay the reasonable funeral expenses of a decedent who was a (i) recipient of public assistance or (ii) state resident receiving Supplemental Security Income. Such payment shall not exceed $1,000.

B. No local department may pay funeral expenses under this section unless (i) each person legally responsible for the support of the decedent is unable to pay the expenses and (ii) other resources, including available death benefits of the decedent's estate, are insufficient to pay the expenses.
