Be it enacted by the General Assembly of Virginia:
1. § 1. The State Corporation Commission (the Commission) shall conduct and monitor an all-source competitive procurement process for Phase I and Phase II Utilities, as such terms are defined in subdivision A 1 of § 56-585.1 of the Code of Virginia. In conducting such process, the Commission shall enable the acquisition of new energy supply resources and the requirements for capacity or generation shall be neutral in terms of technology and ownership of resources. The Commission shall determine the amount of capacity to be competitively procured by each Phase I and Phase II Utility, as informed by relevant resource planning filings, and permit participation from energy resource alternatives and opportunities for resource optimization. The Commission shall determine best practices for the all-source competitive procurement, including methods to fairly evaluate all available supply-side and demand-side resources prior to selecting feasible and cost-effective options. The Commission shall review each Phase I and Phase II Utility's request for proposals before issuance to ensure all available resources will be fairly evaluated. In conducting its review, the Commission may engage a consultant with experience in successful all-source competitive procurement. The Commission shall also require any request for proposals issued under this act to conform in all material aspects to the applicable requirements for procurement of solar and wind resources described in subdivision D 3 of § 56-585.5 of the Code of Virginia.
