Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 22.1-60.2 as follows:

§ 22.1-60.2. Salary of division superintendent; limitation on annual salary.

A. As used in this section, "annual salary" means the fixed total compensation for services paid to a division superintendent in a 52-week year and includes (i) all bonuses, incentive payments, or performance-based payments received per year, whether one-time or recurring; (ii) all forms of deferred compensation, including retirement enhancement annuities, severance provisions, or employer-funded supplemental retirement plans; and (iii) any other financial benefits or remuneration provided by the school board that functions as salary, regardless of how it is labeled or structured. "Annual salary" does not include any reasonable allowances or stipends that are tied to actual documented expenses and not used as supplemental compensation, including travel allowances, technology stipends, or similar expense-based payments.

B. No school board shall pay, agree to, or enter into a contract to pay or otherwise compensate a division superintendent an annual salary that exceeds the amount authorized to be paid to the Superintendent of Public Instruction.

2. That the provisions of the first enactment of this act shall apply to any contract or renegotiated contract for a division superintendent agreed to by a school board on or after January 1, 2027.
