Be it enacted by the General Assembly of Virginia:

1. § 1. That the Department of Medical Assistance Services shall amend subdivision E 3 of 12VAC30-40-280 of the Virginia Administrative Code to increase, as necessary based upon Social Security Administration cost-of-living adjustments, the $75,000 earned income disregard for workers with disabilities. The Department shall seek all necessary federal approval to effectuate such change. The initial adoption of such amendments shall be exempt from the provisions of the Administrative Process Act (§ 2.2-4000 et seq. of the Code of Virginia).
