AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to direct the State Corporation Commission to determine whether certain electric utilities are using reasonable classifications of customers.

Be it enacted by the General Assembly of Virginia:

1. § 1. In at least one biennial review proceeding or other appropriate proceeding for a Phase I and Phase II Utility, as those terms are defined in subdivision A 1 of § 56-585.1 of the Code of Virginia, filed after January 1, 2025 but no later than July 1, 2027, the State Corporation Commission (the Commission) shall, under its existing authority, determine whether the Phase I or Phase II Utility is using rates, tolls, charges, or schedules that contain reasonable classifications of customers. In making this determination, the Commission shall consider whether new or separate customer classifications are reasonable.
