That, notwithstanding the provisions of subdivision A 1 of § 60.2-612 of the Code of Virginia, an unemployed individual, as defined in § 60.2-226 of the Code of Virginia, shall be eligible to receive unemployment compensation benefits pursuant to Title 60.2 of the Code of Virginia for any week for which the Virginia Employment Commission (the Commission) finds that such individual (i) has worked as an independent contractor, as described in 29 C.F.R. § 795.105, for the federal government within the preceding 12 months and (ii) otherwise meets the requirements provided in subdivisions A 2 through 7, 10, and 11 of § 60.2-612 of the Code of Virginia. Such an individual's weekly benefit amount shall be the amount appearing in Column B in the currently applicable Benefit Table in § 60.2-602 of the Code of Virginia, as amended by this act, on the line on which in Column A of such table there appears the total amount paid to such individual by the federal government in the two quarters of his base period in which such total amounts were highest. The Commission shall determine the maximum duration of any such benefits in each case pursuant to § 60.2-619 of the Code of Virginia, as amended by this act. The provisions of this enactment shall expire on January 1, 2026.

4. That the provisions of this act shall not become effective unless an appropriation effectuating the purposes of this act is included in a general appropriation act passed in 2025 by the General Assembly that becomes law.
