AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 53.1-116.2:1, relating to regional correctional facilities; investigation of acts of violence; primary local law-enforcement agency.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 53.1-116.2:1 as follows:

§ 53.1-116.2:1. Jail superintendents to report certain acts of violence occurring within regional correctional facilities to the primary local law-enforcement agency; memorandum of understanding.

A. The jail superintendent of any regional correctional facility shall promptly report to the primary local law-enforcement agency in the jurisdiction where such correctional facility is located any act of violence, as defined in § 19.2-297.1, that occurs within such correctional facility.

B. The jail superintendent shall enter into a memorandum of understanding with such primary local law-enforcement agency in the jurisdiction where such facility is located setting forth the procedures for the investigation of such acts of violence and the respective roles and responsibilities of the jail superintendent of such correctional facility and the local law-enforcement agency to which such report is made. Such memorandum of understanding may include procedures for the primary local law-enforcement agency to request the Department of State Police to conduct an investigation into any such act of violence that occurs within such correctional facility.
