2. That the implementation of the provisions of §§ 19.2-368.5 and 19.2-368.10 of the Code of Virginia, as both are amended by this act, shall be subject to the availability of funds in the Criminal Injuries Compensation Fund, established pursuant to § 19.2-368.18 of the Code of Virginia.
