AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend and reenact § 23.1-611 of the Code of Virginia, relating to public institutions of higher education; student exchange programs; tuition and mandatory fee waivers.
Be it enacted by the General Assembly of Virginia:
1. That § 23.1-611 of the Code of Virginia is amended and reenacted as follows:
§ 23.1-611. Student exchange programs; tuition and mandatory fee waivers.
Tuition and mandatory fees may be waived for a an inbound student from a foreign country enrolled in a public institution of higher education through a formalized student exchange program approved by between such institution and another institution of higher education, provided that the number of inbound students from a foreign country for whom tuition and mandatory fees has been waived does not exceed during any three-year period the number of students from a foreign country who are enrolled through such student exchange program and who pay does not exceed the number of outbound students paying full tuition and mandatory fees to the public institution of higher education under the provisions of the exchange program for a given three-year period. However, each public institution of higher education may consider (i) multiple outbound students who are each enrolled part time at the other institution of higher education to be a single outbound student if the number of credit hours in which such students are enrolled in the aggregate is equal to a full term of enrollment and (ii) multiple inbound students who are each enrolled part time at the public institution of higher education to be a single inbound student if the number of credit hours in which such students are enrolled in the aggregate is equal to a full term of enrollment.
