AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend and reenact § 22.1-259 of the Code of Virginia, relating to Department of Education; [ electronic data exchange system; ] student attendance data.

Be it enacted by the General Assembly of Virginia:

1. That § 22.1-259 of the Code of Virginia is amended and reenacted as follows:

§ 22.1-259. Teachers to keep daily attendance records [ ; electronic data exchange system ] .

Every [ A. ] A teacher in every public school in the Commonwealth shall keep an accurate daily record of attendance of all children, both (i) at the beginning of the school day and (ii) for each class period, in accordance with regulations prescribed by the Board of Education. Such record shall, at all times, be open to any officer authorized to enforce the provisions of this article who may inspect or copy the same and shall be admissible in evidence in any prosecution for a violation of this article as prima facie evidence of the facts stated therein.

[ B. The Department shall establish and implement an electronic data exchange system through which each school board shall submit its student attendance data. Each school board shall make such changes to its student information system as may be necessary to ensure that student attendance data is fully standardized and capable of being seamlessly integrated into the Department's electronic data exchange system. ]
