AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding sections numbered 22.1-288.3 and 63.2-912.1, relating to disclosure of student address to noncustodial parent; limitations; notification.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding sections numbered 22.1-288.3 and 63.2-912.1 as follows:

§ 22.1-288.3. Disclosure of student address to noncustodial parent; limitations.

A. Notwithstanding any other provision of law to the contrary, upon written request of a student's custodial parent, no school board employee shall disclose the address of any student and his custodial parent to any noncustodial parent of such student.

B. Each school board shall take reasonable steps to notify parents of their right to make a written request as set forth in subsection A.

§ 63.2-912.1. Notification of certain rights of foster parents of public school students.

At the time that a child is placed in foster care, each local department of social services shall, if applicable, notify the foster parents of their right to make a written request as set forth in subsection A of § 22.1-288.3.
