C. At the close of each fiscal year, whenever the balance of the Fund exceeds 10 percent of the total operating costs for the hospital and nursing home licensure and inspection program for the preceding fiscal year, the Department shall review the fees collected under the provisions of this article and credited to the Fund and adjust such fees as necessary to ensure that the total fees credited to the Fund each fiscal year are sufficient to cover, but not in excess of, the total operating costs of the hospital and nursing home licensure and inspection program for each fiscal year.
