AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to require an electric utility to provide certain notice prior to the construction of certain electric transmission lines.
Be it enacted by the General Assembly of Virginia:
1. § 1. That, in addition to any notices required pursuant to subsection E of § 15.2-2202 and subsection B of § 56-46.1 of the Code of Virginia, any electric utility that is responsible for the construction, operation, or maintenance of an electric transmission line of 138 kilovolts or more within a locality shall provide written notice to the governing body of such locality at least 90 days prior to the filing of an application with the State Corporation Commission for the approval of such line pursuant to § 56-46.1 or subsection A of § 56-265.2 of the Code of Virginia. Such notice shall include a written description of the route or routes for the transmission line, as well as a map or sketch of such route or routes, including a digital geographic information system map, that the electric utility anticipates proposing in such application. As used in this act, "electric utility" has the same meaning as provided in § 56-576 of the Code of Virginia, except that "electric utility" does not include any Phase I or Phase II Utility, as those terms are defined in subdivision A 1 of § 56-585.1 of the Code of Virginia, or the affiliate of a Phase I or Phase II Utility.
