Notwithstanding any other provision of law to the contrary, the Commissioner shall not deny a license to an applicant under this chapter based solely on any action taken by the applicant, or any officer, principal, manager, or director of the applicant, if such action was taken in good faith upon the legal advice of the applicant's counsel, unless the applicant:

1. Has knowingly made a false statement of a material fact in the application or has deliberately failed to disclose any information requested by the Commission;

2. Is or has been guilty of any corrupt or fraudulent practice or conduct in connection with gaming operations in the Commonwealth or any other state;

3. Has knowingly failed to comply with the provisions of this chapter or the regulations promulgated pursuant to this chapter;

4. Has had any license or permit to engage in activity related to gaming denied for cause, suspended, or revoked in the Commonwealth or any other state, and such denial, suspension, or revocation is still in effect; or

5. Has been convicted of a misdemeanor or felony involving unlawful conduct of wagering, fraudulent use of a gaming credential, unlawful transmission of information, touting, bribery, embezzlement, or distribution or possession of drugs, excluding misdemeanor possession of marijuana.

20. That the provisions of ยงยง 18.2-325, 18.2-326, and 18.2-334.2 through 18.2-334.5 of the Code of Virginia, as amended by this act, are declarative of existing law.

21. That the provisions of this act shall not be construed to diminish or infringe upon any right protected under the First Amendment or the Fourteenth Amendment to the Constitution of the United States or under the Constitution of Virginia.

22. That, notwithstanding any other provision of this act, nothing within this act shall be construed to create any jurisdiction over any other form of gaming, authorized by law, beyond that specifically enumerated and defined herein.

23. That the provisions of this section shall not supersede or interfere with any state law or local ordinance that prohibits a person under the age of 21 from entering a place of public accommodation.
