Be it enacted by the General Assembly of Virginia:

1. § 1. That, pursuant to recommendation five of the Joint Legislative Audit and Review Commission's report to the Governor and the General Assembly on Data Centers in Virginia, dated December 9, 2024, a Phase II Utility, as defined in § 56-585.1 of the Code of Virginia, shall develop a plan every two years for addressing the risk of generation and transmission infrastructure costs associated with providing electric service to new customers that are data centers, as defined in subdivision A 43 of § 58.1-3506 of the Code of Virginia, being stranded with existing customers. The Phase II Utility shall file such plan with the State Corporation Commission as part of its biennial review filing pursuant to § 56-585.1 of the Code of Virginia.
