Be it enacted by the General Assembly of Virginia:
1. § 1. The Department of Health (the Department) shall adopt regulations that allow a caterer located outside of the Commonwealth to provide food services for events located in the Commonwealth. Such regulations shall include a permitting process and food safety requirements applicable to out-of-state caterers. The Department shall offer such permit to any food service establishment that meets the requirements established by such regulations, including restaurants, and shall allow preparation of food to occur at facilities located outside of the Commonwealth. A permit granted pursuant to such regulations shall only allow out-of-state caterers to serve food at temporary, short-term events. No permit granted pursuant to such regulations shall allow an out-of-state caterer to operate a permanent food service establishment in the Commonwealth without obtaining the appropriate permit from the Department.
