Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 7 of Chapter 8 of Title 46.2 a section numbered 46.2-869.1 as follows:
§ 46.2-869.1. Injuring or causing the death of another while recklessly, aggressively, or improperly driving a vehicle with a prohibited altered suspension system; penalties.
Any person who, while operating a motor vehicle with suspension system alterations prohibited by § 46.2-1063, (i) engages in reckless driving in violation of § 46.2-852, aggressive driving in violation of § 46.2-868.1, or improper driving in violation of § 46.2-869 and (ii) causes serious bodily injury as defined in § 18.2-51.4 to another person or the death of another person shall be subject to the following penalties:
1. Upon a first conviction for such a violation, the court shall, in addition to penalties imposed pursuant to § 46.2-868, 46.2-868.1, or 46.2-869 or any other penalties imposed by law, (i) suspend the driver's license of such person for a period of 90 days, (ii) order the surrender of the license to be disposed of in accordance with the provisions of § 46.2-398, and (iii) order the completion of 150 hours of community service.
2. Upon a second or subsequent conviction for such a violation, the court shall, in addition to penalties imposed pursuant to § 46.2-868, 46.2-868.1, or 46.2-869 or any other penalties imposed by law, (i) suspend the driver's license of such person for a period of one year, (ii) order the surrender of the license to be disposed of in accordance with the provisions of § 46.2-398, and (iii) impose a penalty of $1,500.
