Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 35.1-14.01 as follows:
§ 35.1-14.01. Restaurants and catering operations providing notice of food containing pork products; civil penalty.
A. For purposes of this section, "catering operation" means a person who contracts with a client to prepare a specific menu and amount of food in a permitted food establishment for service to the client's guests or customers at a service location different from the permitted food establishment. Catering may also include cooking or performing final preparation of food at the service location.
B. Every restaurant and catering operation operating in the Commonwealth that provides a menu to its customers shall include in a conspicuous manner a notice if an item on the menu contains pork products. Such notice shall be next to or directly underneath items containing pork products.
C. Every restaurant and catering operation shall post a copy of the menu created pursuant to subsection B in a conspicuous location accessible to all employees involved in the preparation or service of food.
D. A restaurant or catering operation that violates the provisions of this section is subject to a civil penalty not to exceed $200 for each violation.
