Be it enacted by the General Assembly of Virginia:

1. That § 2.2-4319 of the Code of Virginia is amended and reenacted as follows:

§ 2.2-4319. Cancellation, rejection of bids; waiver of informalities; local budget.

A. An Invitation to Bid, a Request for Proposal, any other solicitation, or any and all bids or proposals, may be canceled or rejected. The reasons for cancellation or rejection shall be made part of the contract file. A public body shall not cancel or reject an Invitation to Bid, a Request for Proposal, any other solicitation, bid, or proposal pursuant to this section solely to avoid awarding a contract to a particular responsive and responsible bidder or offeror.

B. A public body may waive informalities in bids.

C. Counties, cities, and towns may make an Invitation to Bid, a Request for Proposal, and any other solicitation prior to budgeting an anticipated expenditure for such proposal and may include a statement in an Invitation to Bid, a Request for Proposal, or any other solicitation of an intention to cancel any such invitation, request, or solicitation if all bids exceed the anticipated expenditure.
