A BILL to amend the Code of Virginia by adding in Article 3 of Chapter 34 of Title 54.1 a section numbered 54.1-3436.2 and by adding in Article 4 of Chapter 34 of Title 54.1 a section numbered 54.1-3442.03, relating to Drug Control Act; manufacturers, wholesale distributors, and medical equipment suppliers; annual report.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 3 of Chapter 34 of Title 54.1 a section numbered 54.1-3436.2 and by adding in Article 4 of Chapter 34 of Title 54.1 a section numbered 54.1-3442.03 as follows:

§ 54.1-3436.2. Annual report required.

Each wholesale distributor or medical equipment supplier licensed, permitted, or registered pursuant to this article shall, on or before January 30 of each calendar year, submit an advertising spending report to the Board in accordance with the provisions of this section for the immediately preceding calendar year. Such report shall include the amount such wholesale distributor or medical equipment supplier spent on direct-to-consumer advertising of each prescription drug or device, as applicable. The report shall be completed on forms prepared and furnished by the Board. The Board shall compile all information reported by wholesale distributors and medical equipment suppliers and shall publish a report of such information on or before May 1 of each year.

§ 54.1-3442.03. Annual report required.

Each manufacturer permitted or registered pursuant to this article shall, on or before January 30 of each calendar year, submit an advertising spending report to the Board in accordance with the provisions of this section for the immediately preceding calendar year. Such report shall include the amount such manufacturer spent on direct-to-consumer advertising of each prescription drug or device, as applicable. The report shall be completed on forms prepared and furnished by the Board. The Board shall compile all information reported by manufacturers and shall publish a report of such information on or before May 1 of each year.
