Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 4.1-206.4 as follows:

§ 4.1-206.4. Requirements for certain retail licensees; provision of free potable water.

A. Persons granted a retail license to sell alcoholic beverages for on-premises consumption pursuant to any of the following provisions shall provide free potable water to customers who have placed an order upon request:

1. Subdivision A 1, 6, 8, or 12 of § 4.1-206.3; or

2. Subdivision B 1 of § 4.1-206.3.

B. For the purposes of this section, "potable water" means water that is safe for human consumption.
